Terms of service

These terms govern your use of the Analux app, website, API and related services (the “service”), provided by Analux (“we”, “us”). By creating an account or using the service you agree to them. If you do not agree, do not use the service. How we handle personal data is in our privacy policy.

1. Accounts

You must be at least 16, or the age of majority where you live, to use the service. The information you give us must be accurate, and if you sign up for an organisation you must have authority to bind it.

You are responsible for keeping your sign-in details private and for activity under your account. Tell us at security@analux.app straight away if you suspect someone else has access.

2. Acceptable use

You agree not to:

  • break the law, infringe anyone’s rights, or harm minors using the service;
  • upload data you do not have the right to process, or anything containing malware;
  • probe, scan or test the security of the service without our written permission;
  • reverse-engineer the service except where the law expressly allows it;
  • overload the service, or use it to build a competing product;
  • resell or share access beyond what your plan allows.

3. Your data

You keep ownership of the data you upload or connect, the gauges you create and the readings they produce (“your content”). You give us a limited, worldwide, royalty-free licence to host, process and display your content only as needed to run, secure and improve the service for you.

We do not sell your content and do not use it to train AI models. Our providers process it only to deliver the service, as described in the privacy policy.

4. Readings, forecasts and explanations

Gauges compute metrics, baselines, ranges, level shifts and forecasts with SQL and statistical methods, and a language model writes explanations of the results. Statistical judgements are probabilistic: a reading can be flagged when nothing is wrong, or not flagged when something is, and a forecast range can be missed. Explanations can contain mistakes.

Readings are decision support. Review them before relying on them, especially for financial, legal, employment, lending or other consequential decisions. Results also depend on the data you provide: if an export is incomplete or late, the reading reflects that.

Gauges run on a schedule, but we do not guarantee that every scheduled run happens at the exact time or that every email is delivered. A run that fails is recorded as failed.

5. Plans

The service has a free plan and paid plans. What each one includes, such as how many gauges you can run and how often they check, is on the pricing page, and the limits shown there are the limits that apply to your account. We may add features at any time and may change a plan’s limits for new accounts. For an account on a paid plan, we will give at least 30 days’ notice by email before a change that reduces what the plan includes.

6. Paid plans and billing

Paid plans are charged in US dollars, in advance, and renew automatically each billing period until cancelled. Cancelling takes effect at the end of the current period. Fees are non-refundable except as set out in our refund policy, which gives a full refund within 14 days of a first subscription charge, or where the law requires otherwise. We will give at least 30 days’ notice of any price change, and continuing to use a paid plan after the change takes effect means you accept it.

7. Suspension and closing an account

We may suspend or end access if you break these terms, fail to pay, or put the service or other users at risk. Where it is reasonable, we will warn you first and give you a chance to fix the problem. You can close your account at any time by writing to privacy@analux.app; your data is then deleted within 30 days.

8. Intellectual property

The service, including its software, design and trademarks, belongs to Analux. We give you a limited, revocable, non-exclusive, non-transferable licence to use it under these terms. No other rights are granted.

9. Disclaimers

To the extent the law allows, the service is provided “as is” and “as available”, without warranties of any kind. We do not promise that it will be uninterrupted or error-free, or that readings, forecasts or explanations will be accurate or suitable for a particular purpose.

10. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or revenue, even if told they were possible. Each party’s total liability under these terms is limited to the greater of the fees you paid us in the 12 months before the claim arose and USD 100.

11. Indemnity

You will defend and indemnify us against third-party claims arising from your content, your breach of these terms, or your unlawful use of the service.

12. Changes to these terms

We may update these terms. We will announce material changes in the app or by email at least 14 days before they take effect. Continuing to use the service after that date means you accept the new terms.

13. Governing law

These terms are governed by the laws of the jurisdiction in which Analux is incorporated, without regard to conflict of laws rules, and disputes will be resolved in its courts, unless mandatory law where you live says otherwise.
